It was unclear, Senator Mullen said, “whether the Irish Government intends to root these guarantees in the Irish Constitution, or whether they will simply operate at the level of EU law, subject to the interpretation of the European Court of Justice (ECJ), with all the uncertainty that brings”.

He said that fears about the ECJ extending its reach into sensitive social issues were not “alarmist”. Citing the Maruko case of last year, he said that the Court had insisted that a member State give same-sex couples the same pension rights as married couples, despite the fact that the legislation upon which it was relying explicitly stated that it was “without prejudice to national laws on marital statues and the benefits dependent thereon”.

The fact that the Government had not acknowledged such “competence creep” was worrying, he added. He pointed out that if the Government were to go ahead with its plans for civil partnership legislation, it could be forced to go further and make it equivalent to marriage, thanks to the Maruko ruling, unless credible guarantees are put in place.

If the Government wanted to get the votes of socially traditionalist voters, it needed to “ensure that the guarantees it has negotiated turn out to be substantial when tested against the range of challenges that might arise in the future”.
