A group of Fianna Fáil TDs and Senators are supporting a motion in the parliamentary party to secure the special status of marriage under the Constitution. The motion comes just days after the Government published the heads of a Bill which proposes giving same sex couples many of the rights currently enjoyed by married couples.

The motion was put forward last night by Wexford-based Senator Jim Walsh. The wording seeks to ensure that nothing is done in the upcoming Civil Partnership Bill which would make same sex civil partnerships equate to marriage.

The Irish Times is reporting that the issue is set to be discussed at next week's meeting of Fianna Fáil's parliamentary party. It is believed that the Government will ask the parliamentary party's justice committee to look into the matter.

Senior backbench TDs and Senators speculated last night that at least 12 and up to 30 members of the parliamentary party had signed Senator Walsh's motion.

"The motion would have considerable support from the more conservative sections of the parliamentary party," said a senior Senator last night, speaking on condition of anonymity.

"I don't see any great need to legislate in this area. I have my own views on it. Let people do what they want, but I don't see the need to be putting things into the statute book," said another, who equally would not be quoted by name.

Under the parliamentary party's rules, motions for debate for meetings have to be lodged with the group's chairman, Louth TD Séamus Kirk, by the previous Thursday.

The development comes after a series of reports prior to Tuesday's publication of the heads of the Civil Partnership Bill indicated that there was considerable unease among some Fianna Fail TDs and Senators about legislation which would give same sex couples marriage like rights. It had been thought that opposition to such legislation within Fianna Fail had led to the delay in publication of the legislation.

The Cabinet cleared the heads of the legislation last Tuesday, and a full Bill should be ready to go before the Houses of the Oireachtas in six months and to be law within about a year.

The Civil Partnership Bill would same sex couples greater rights and control over pensions, inheritance and tax, but it would not allow same-sex couples to adopt.
