A High Court ruling that has denied access and guardianship rights to a sperm donor father was "anti-child and anti-father", according to the Iona Institute. David Quinn, the director of the Institute, said that Mr Justice John Hedigan's judgment was "badly misguided" and ignores a child's right to be raised by a father where possible. The ruling was also attacked by groups representing unmarried fathers.

The High Court has ruled that a sperm-donor father has no access or guardianship rights to his child. The case involved a sperm donor who was seeking guardianship rights in relation to a child he had fathered on behalf of a lesbian couple. The man had agreed to father the child on the basis that he would have role of "favourite uncle" to the child, and had obtained leave to seek access and guardianship rights in the Supreme Court last year.

Mr Justice Hedigan said that the rights of a man who acted as a sperm donor were no greater than those of an unmarried father, and the ‘blood link’ was of little weight and not a determining factor in terms of his decision. It is believed the man will appeal the decision to the Supreme Court.

The judge said that the rights of a man who acted as a sperm donor were at least no greater than those of an unmarried father. Under Irish law an unmarried father has no automatic rights to his child. In considering his application for guardianship the child's welfare was the paramount consideration, the judge stated.

The man had a right to apply to be appointed as a guardian but had no right to be appointed a guardian, the judge went on.

He further found that, as the evidence established no relationship other than a biological one between the man and child, the man did not have family rights under article 8 of the human rights convention. However, he found that a lesbian couple living together in a long-term committed relationship with a child could be regarded as a de facto family enjoying rights under the European Convention on Human Rights.

The paramount issue in the case was the welfare of the child, he went on. The child, Mr Justice Hedigan said, lived in a "loving, secure, de facto family" with the lesbian couple, who had undergone a civil union ceremony in England and been together for 13 years. The evidence revealed that the couple were "excellent parents", he added.

A court-appointed expert, a psychiatrist, said the man should not have rights which could interfere with the child's family life with the couple and had recommended against guardianship or access. In his view, he said, the evidence amply confirmed the expert's view.

The judge noted the couple believed that the child should know who his biological father was and were prepared for the man to have contact with the child at an "age appropriate" time.
